What You Should Do After an Accident to Help Your Whiplash Settlement

If you want the best chances of having a successful result in your whiplash settlement, there are several things that you should do immediately after your crash.  These are simple actions, but they will make your case much easier and give the insurance company less ability to cast doubt on your claim and offer you less as a settlement.

First, you should always immediately seek medical treatment after the accident if you feel like you have been injured in any way.  Also get the police involved in the accident report and inform them that you think you sustained an injury and will be seeking immediate treatment.  When you do seek treatment, get a note from the doctor or hospital that you go to and save any receipts you get.  This will give you several different witnesses and types of proof that you did indeed sustain an injury in the auto accident.  The longer you wait for treatment, even if the injury is real, makes it more and more likely that you are committing insurance fraud and have injured yourself somewhere else and are using the auto accident as an excuse to have someone else foot the bill.

Also make sure that you keep an accurate record of all the expenses you incur as a direct result of the accident.  This includes any bills from auto repair shops, rental cars you had to obtain, hospital bills, time missed from work, ongoing treatment as a result of injuries sustained in the accident, and any other property damaged in the accident.  This will make determining your final settlement amount much easier.

Finally, you’ll want to make sure that you keep the details of the crash right in your head.  As soon as you can after the accident write down everything you remember about the accident, including any diagrams your can draw.  This will make sure that you have accurate, concise, detailed information any time that you are questioned about the accident and you don’t change your story.

Getting the most out of your whiplash settlement can be difficult at times.  However, with some proper action taken right after the accident, you should be able to go through negotiations with insurance companies much easier and get the money that you deserve.
